Terms & Conditions
By registering for or attending any program, workshop, class, ensemble rehearsal, or event offered by Discovery Sound Garden (“DSG”), you (and the parent or guardian of any minor participant) agree to the following terms. Please read carefully before completing registration.
  1. Registration & Eligibility
    Programs are generally open to adults 18+. Programs open to minors are noted in the program description.
    • Registration is not confirmed until full payment (or an approved payment plan) is received and a confirmation email is issued.
    • You are responsible for providing accurate contact, health, and emergency information at registration.
    • Minors under 18 require written consent from a parent or legal guardian.
    • DSG reserves the right to limit enrollment to maintain program quality and safety. Waitlists are available when programs reach capacity; placement on a waitlist does not guarantee enrollment.
  1. Fees, Payment & Financial Assistance
    • All current fees are listed on the program registration page.
    • Full payment is required at registration unless a payment plan is approved in writing by DSG staff.
    • Returned or declined payments may result in a processing fee and/or loss of your registration.
    • Limited scholarships and sliding-scale fees may be available. Contact DSG before registering to inquire—availability is not guaranteed.
  1. Refund & Cancellation Policy Cancellations by Participant
    • 7 days before program start: full refund minus a $10 fee.
    • 3-6 days before program start: 50% refund.
    • Fewer than 2 days before program start: no refund.
    • For multi-session programs, no refunds are issued once a session has begun (see Extenuating Circumstances below). Missed Classes Refunds are not issued for classes missed by the participant. DSG may offer makeup sessions or recordings at its discretion. Extenuating Circumstances — When a Refund or Credit May Be Considered DSG recognizes that unexpected situations arise. The following circumstances may qualify for a credit toward a future program (at DSG's discretion):
    • Documented medical emergency or serious illness of the participant or an immediate family member.
    • Sudden, unavoidable life event (e.g., bereavement, sudden relocation, job loss) that prevents participation.
    • An accommodation need that DSG is unable to fulfill after good-faith efforts.
    • A significant, undisclosed change to the program (schedule, format, or instructor) that materially affects your ability to participate. To request a credit under extenuating circumstances, submit a written request with supporting documentation to DSG. Requests are reviewed on a case-by-case basis; approval is not guaranteed.     • If DSG cancels a program before it begins, you will receive a full refund or, at your option, a credit toward a future program.
    • If a program is shortened due to unforeseen circumstances (e.g., facility issues, instructor illness), DSG will provide a prorated credit or refund at its discretion.
    • DSG is not responsible for travel, accommodation, or other expenses incurred in the event of a cancellation.
  1. Attendance
    • Regular attendance is expected, especially in ensemble and cohort-based programs where your presence affects other participants.
    • Please notify DSG as soon as possible if you cannot attend a session.
    • Three or more unexcused absences in an ongoing ensemble or cohort program may result in removal without a refund. Attendance thresholds are communicated in program materials.
  1. Community Standards & Conduct DSG is committed to a safe, inclusive, and welcoming environment for all, regardless of age, race, gender identity, sexual orientation, disability, religion, or musical experience. All participants are expected to:
    • Treat fellow participants, instructors, volunteers, and staff with courtesy and respect.
    • Use inclusive and affirming language.
    • Follow instructor directions and care for shared instruments and spaces.
    • Refrain from disruptive behavior, including excessive talking or unauthorized mobile device use during sessions. The following will not be tolerated and may result in immediate removal without a refund:
    • Harassment, bullying, or discrimination of any kind.
    • Physical aggression or threatening behavior.
    • Abusive, demeaning, or hateful language.
    • Unauthorized recording of instructors or other participants.
    • Possession or use of alcohol (except where explicitly permitted for adults 21+), illegal substances, or weapons on DSG premises.
  1. Health, Safety & Accessibility
    • Participants with health conditions relevant to program participation are encouraged to disclose this at registration so accommodations can be arranged.
    • If you are experiencing contagious illness symptoms (fever, active respiratory illness, vomiting), please stay home and notify DSG.
    • Accommodation requests (seating, lighting, sensory, printed materials, etc.) should be submitted at least one week before the program start date.
    • Participants with severe allergies or medical conditions requiring on-site medication should notify DSG staff and be prepared to self-administer, as DSG staff are not medical providers.
    • DSG is not liable for lost or stolen personal belongings. Participants must follow all venue rules.
  1. Photo, Video & Media
    • DSG may photograph or record programs for educational, promotional, and grant reporting purposes. By participating, you grant DSG a non-exclusive, royalty-free license to use your image and likeness in DSG publications, social media, and website content.
    • To opt out of photography or recording, notify DSG in writing at registration by emailing rbaskin.dsg@gmail.com. DSG will make reasonable efforts to exclude you from public-facing materials.
    • Participants may not record other participants or instructors without explicit consent. Consented recordings are for personal use only.
  1. Intellectual Property
    • All DSG curriculum, handouts, recordings, and program materials are the intellectual property of Discovery Sound Garden and may be used for personal study only. Redistribution or commercial use requires written permission.
    • Compositions created by participants remain the intellectual property of the participant. Participants grant DSG a limited license to use their works for program demonstration and grant reporting.
  1. Privacy & Data
    • DSG collects personal information (name, contact details, emergency contacts, health disclosures) solely for program administration, safety, and communication.
    • Your information will not be sold or shared with third parties for commercial purposes.
    • DSG may share information with instructors, volunteers, or venue partners as necessary to deliver the program.
    • By registering, you may be added to DSG's mailing list. You may unsubscribe at any time; this will not affect program communications.
    • You may request deletion of your personal data by contacting DSG in writing.
  1. Assumption of Risk & Limitation of Liability
    • Participation in music programs involves physical activity and instrument use. You voluntarily assume the inherent risks, including physical exertion, repetitive motion, and acoustic exposure.
    • To the fullest extent permitted by law, you release, waive, and hold harmless DSG, its board, officers, employees, volunteers, and instructors from all claims arising from your participation, except in cases of DSG's gross negligence or intentional misconduct.
    • DSG's total liability to any participant shall not exceed the total fees paid by that participant for the applicable program. Participants with medical conditions or physical limitations are encouraged to consult a healthcare provider before participating.
  1. Program Changes & Cancellations
    • DSG reserves the right to modify program schedules, locations, instructors, or content. You will be notified as early as possible of any material changes.
    • If minimum enrollment is not met, DSG may cancel the program and issue full refunds.
    • DSG is not liable for cancellations caused by circumstances beyond its control (natural disasters, public health emergencies, government orders, venue closures). In such cases, DSG will offer a credit or reschedule when feasible.
  1. Grievances & Governing Law
    • Concerns about a program, instructor, or fellow participant should be submitted to DSG leadership in writing. DSG will acknowledge within 10 business days and respond substantively within 20 business days.
    • Both parties agree to attempt informal resolution in good faith before pursuing formal remedies.
    • These terms are governed by the laws of the state in which Discovery Sound Garden is incorporated.
  1. Policy Updates DSG may update these terms at any time. Continued participation following notice of a change constitutes acceptance of the updated terms.
